Assessment
Truitt Environmental Solutions, LLC has extensive experience in reviewing and assesing a myriad of important environmental documents such as permits, inspection reports, Phase I and II environmental site assessments, compliance audits, NOVs, agency correspondence and orders, and transaction documents. We then work with clients to develop and implement a path forward that minimizes the risk of litigation and enforcement. Examples of Mr. Truitt's work include:
- assessing the currency and sufficiency of environmental permits;
- evaluating compliance with existing permit conditions;
- reviewing environmental site assessments for adequacy and completeness and assessing recognized environmental conditions;
- assisting technical consultants with the development, implementation, and evaluation of environmental compliance audits and corrective measures
- review of agency directives and other records to assess their significance and to assist in the development of appropriate responses;
- assessing purchase, lease, lending and other transaction documents to minimize the risk of environmental liability
Advocacy
At times, it becomes necessary to represent a client's position before environmental agencies and with private parties. Truitt Environmental Solutions understands the regulatory framework and mindset of environmental regulators and enforcement personnel and is very experienced in explaining and advocating its client's interests before such officials and bodies. Effective negotiation with private parties and their advocates is also a key capability that Truitt Environmental Solutions, LLC maintains. Examples of Mr. Truitt's environmental advocacy experience that has saved clients significant costs and risks include:
- negotiation of environmental permit limits, terms and conditions;
- presentation and negotiation of environmental remediation proposals;
- negotiation of allocation of environmental cleanup costs among multiple parties;
- negotiation of contract and transaction agreement terms to minimize environmental risks
Mediation
Frequently environmental disputes can be resolved without the time and expense of litigation. Truitt Environmenal Solutions, LLC believes that mediation using a third-party neutral can be an effective tool for finding common ground among differing views and interests. Mr. Truitt has been involved as an advocate in a number of successful mediations of environmental claims and is also a trained mediator.
