Team Biographies
Wm. Roger Truitt has extensive environmental litigation and counseling experience under CERCLA, RCRA,TSCA, the Clean Air Act, the Clean Water Act, and numerous state environmental statutes and regulations. For the past 31 years, his practice has been devoted exclusively to environmental law and related fields. In addition to representing industrial, utility and municipal clients, he frequently provides environmental advice in connection with commercial real estate transactions, major project financings, industrial site cleanups and environmental audits.
Mr. Truitt's litigation experience includes several well-known federal and state cases. He served as the petitioner's lead counsel and argued the Kent County, Delaware Levy Court v. U.S. Environmental Protection Agency, 963 F.2d 391 (D.C. Cir. 1992) case, in which an EPA National Priorities List ("NPL") site designation was overruled for the first time. Mr. Truitt briefed and argued a Clean Streams Law case after persuading the Pennsylvania Supreme Court to grant a discretionary appeal in Adams Sanitation Co., Inc. v. Comm., Dept. of Environmental Protection, 715 A.2d 390 (Pa. 1998). In addition, he defended the owner/operator of a Pennsylvania landfill in a mega-party Superfund cost recovery case, United States v. Keystone Sanitation Company, Inc., C.A. No. 1:CV-93-1482 (M.D. Pa.) and represented a railroad company in connection with remediation and litigation involving the Paoli Rail Yard Superfund Site near Philadelphia that included the removal of PCB contaminated soils and sediments. Currently, Mr. Truitt represents a major electric utility at two Superfund sites in Maryland, is counseling and negotiating wastewater discharge permit issues for a Fortune 500 company in Maryland, is assisting a Maryland family with respect to a contaminated industrial property in Ohio and is advising a Maryland company with environmental concerns at a facility in North Carolina.
Mr. Truitt has represented several water utilities in Florida and Maryland in their efforts to preserve potable wells for their users. In Delaware, he also helped a natural gas utility assess its position in connection with the cleanup of a former manufactured gas plant and has represented two counties with respect to TMDL issues affecting their wastewater treatment plant discharges. Over the past 30 years, Mr. Truitt has assisted numerous land owners and real estate developers resolve environmental issues in Maryland and Delaware.
Mr. Truitt has chaired PRP steering committees and completed successful negotiation of an EPA consent decree and private settlement agreement on behalf of the operator of the Bush Valley Landfill Superfund site. United States v. American Cyanimid Co., Inc., C.A. No. LO-98-22 (D.C. Md.). He also was an active participant in ADR proceedings for a Connecticut Superfund landfill site that was one of EPA’s pilot ADR projects.
Mr. Truitt has represented local governments, utility and industrial clients on complex regulatory issues such as Total Maximum Daily Loads (TMDLs), NPDES permit negotiations and compliance, Title V operating permits, new source review and hazardous waste management. He frequently assists businesses with environmental compliance audits and voluntary disclosure decision-making. In the transactional area, Mr. Truitt regularly advises buyers, sellers and lenders on environmental issues related to the sale, acquisition and financing of industrial and commercial real estate and related facilities. These representations include assessing environmental risks, managing site cleanups and negotiating with buyers, purchasers and environmental agencies.
Mr. Truitt received Bachelor of Arts and Bachelor of Civil Engineering Degrees from the University of Delaware in 1973 and was an honors graduate of the University of Baltimore School of Law in 1982 where he was a member of the law review and its nationally-ranked appellate advocacy team. He was born in Lewes, Delaware in 1950 and is admitted to practice law in Maryland and the District of Columbia.
With nine years of environmental engineering experience, Mr. Truitt adds considerable technical expertise to the firm's approach in handling environmental problems. He has been a registered professional engineer in Maryland and Delaware and was employed by several local governments and the U.S. Department of the Air Force in an environmental engineering capacity before becoming an attorney.
